日本国憲法第3章にある日本国憲法の条文の一つで、自由・権利の保持の責任、濫用の禁止を規定する。
条文は次の通り。
第三章 国民の権利及び義務
第十二条 この憲法が国民に保障する自由及び権利は、国民の不断の努力によつて、これを保持しなければならない。又、国民は、これを濫用してはならないのであつて、常に公共の福祉のためにこれを利用する責任を負ふ。
日本国首相官邸公式サイト掲載の英文(正文ではない翻訳)では、次のようになっている。
CHAPTER Ⅲ. RIGHTS AND DUTIES OF THE PEOPLE
Article 12.
The freedoms and rights guaranteed to the people by this Constitution shall be maintained by the constant endeavor of the people, who shall refrain from any abuse of these freedoms and rights and shall always be responsible for utilizing them for the public welfare.
国民の自由や権利は、国民の不断の努力によって勝ち取るものである旨、書かれている。
自由や権利は、決して無条件に得られたり、空から降って来たりするものではなく、あくまで努力して得るものである。しかも、それも決して絶対的なものではなく、公共の福祉に反するようなものは有り得ない旨、書かれている。
