　条文は次の通り。
　第三章 国民の権利及び義務
　第二十五条 すべて国民は、健康で文化的な最低限度の生活を営む権利を有する。
　(2) 国は、すべての生活部面について、社会福祉、社会保障及び公衆衛生の向上及び増進に努めなければならない。

　Article 25.
　1. All people shall have the right to maintain the minimum standards of wholesome and cultured living.
　2. In all spheres of life, the State shall use its endeavors for the promotion and extension of social welfare and security, and of public health.
考え方
　国民は、文化的な生活を送る権利があることが規定されている。
　これを実現するため、国はその旨努力せねばならない。
　この憲法が作られる前より生活保護法という法律があり、自力で生活出来ない者を保護する法律があったが、この憲法が出来てからは、生活保護制度は憲法が保障するものとなった。
　なお、この条文は国民に対して具体的な権利を付与するものではなく、福祉政策は国の裁量次第とする判例がある。
